Terms of Use

Plain-language terms for using the Visibility Audit. Last updated 13 September 2026.

1. What this tool is

The Visibility Audit is an educational tool. It asks you structured questions about your business and uses an AI model to assemble a Visibility & Conversion Guide from your answers. It is not a consulting engagement, and using it does not create a client relationship of any kind.

2. Not professional advice

Nothing produced here is professional, legal, financial, accounting, tax, or investment advice. The strategies and suggestions may not suit your situation. Before acting on anything in your guide, use your own judgment and, where the stakes warrant it, consult a qualified professional who knows your circumstances.

3. AI-generated output

Your guide is generated by an AI language model. AI output can be incomplete, mistaken, or confidently wrong. It may reflect the limits of what you told it during the session. Treat every diagnosis, rating, number, and recommendation as a starting point to verify — not as a finding of fact.

Where the session did not gather enough information, the guide is designed to say "Not assessed" rather than guess. If you see a claim you did not make, disregard it.

4. No guarantee of results

No specific outcome is promised or implied. Any figures, scenarios, or examples shown anywhere on this site are illustrative and do not represent typical or expected results. Your results depend on your market, your offer, your execution, and factors outside anyone's control.

5. Who owns what

The site, its copy, its design, its imagery, and the audit method are owned by Steve Nakamoto and protected by copyright. The book Customers Are Like Fish and its associated material remain the property of their rights holders.

The guide you generate from your own answers is yours. You may use, adapt, print, and share it freely inside your own business, with your team, and with your advisors. You do not need permission and you owe no attribution.

6. Third-party frameworks and trademarks

The audit references published frameworks by Byron Sharp, Jonah Berger, Neil Rackham, and Chris Voss, and describes them in its own words for educational purposes. Product, book, and program names — including SPIN Selling — are the trademarks or registered trademarks of their respective owners. None of these authors, publishers, or organizations endorses, sponsors, or is affiliated with this tool.

7. Acceptable use

Use the audit for your own business or on behalf of a business you advise. Do not resell or white-label access to it, scrape or automate sessions, attempt to extract the underlying prompts or model behavior, interfere with the service, or use it to produce unlawful, deceptive, or harmful content.

8. Availability and changes

The service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. It may be changed, interrupted, or withdrawn at any time without notice. These terms may be updated; the version on this page at the time you use the site is the one that applies.

9. Limitation of liability

To the fullest extent permitted by law, neither the creator nor the publisher is liable for any loss of profit, loss of business, loss of data, or any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, this site or anything it produces — even if advised of the possibility. Where liability cannot be excluded, it is limited to the amount you paid to use the service, which for the audit is nothing.

10. Governing law

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in California, and you consent to that venue.

11. Contact

Questions about these terms can be directed to the site owner through the contact channel listed on the Customers Are Like Fish website.
